Limited Liability Indemnity

This page sets out the limits of our liability, and your indemnity to us, when you use roomdivider.irish or buy from Room Divider Company, a division of Caruso Consulting Co Ltd ("we", "us" or "our"). It forms part of our Terms & Conditions.
Your rights under the law come first
Nothing on this page limits or excludes any liability that cannot lawfully be limited or excluded. That includes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, and rights or remedies under the Consumer Rights Act 2022 and other applicable consumer law. Those rights take priority over anything on this page.
Limitation of our liability
We are responsible for loss or damage that is a foreseeable result of our breach of contract or our failure to use reasonable care and skill. Subject to your statutory rights:
- We do not supply consumer products for commercial use and are not responsible for business losses such as loss of profit, revenue, data, goodwill or opportunity.
- We are not liable for loss or damage caused by misuse of a product, by not following its instructions, or by normal wear and tear.
- We are not responsible for delay caused by events outside our reasonable control, but we will contact you, take reasonable steps to minimise the effect and let you cancel for a refund where the law or our terms give that right.
Using our products
Room dividers, screens, tracks, rods and their accessories need care. Unless a product page says otherwise, we do not claim that any of our products will prevent injury or loss. Please use each product only as its page and the manufacturer's instructions describe, including the permitted location, mounting method and clearances. Except where we have acted fraudulently or with wilful misconduct, and subject to your rights above, you are responsible for how you use the products, and for any damage to you, your property or anyone else that comes from using them.
Website availability and third parties
We try to keep the site available and working, but it is provided "as is" and we do not promise uninterrupted or error-free access. We may suspend, withdraw or change all or part of the site without notice.
We are not responsible for fraud, theft, hacking, interception, tampering or other unlawful acts by third parties that are outside our control.
This site and our products are meant for customers in Ireland. Please do not buy or use them anywhere that doing so would break the local law.
Your indemnity
If you deliberately use this site unlawfully or infringe another person's rights, you are responsible for the reasonable, foreseeable loss that your conduct directly causes us. This does not make a consumer responsible for matters outside their control or remove any statutory right.
